Section 78C of the Right to Information Act 2009 (RTI Act) allows individuals to apply to an agency to have their personal information amended if it is inaccurate, incomplete, out of date, or misleading.

An amendment application must:

  • be made in writing – it does not need to be made on the approved form
  • be accompanied by the applicant’s certified identification
  • if made on behalf of the applicant, be accompanied by the agent’s authority to act
  • if made by a parent on behalf of a child applicant, be accompanied by proof of relationship
  • relate only to the applicant’s personal information that is contained in the documents held by QFD; and
  • provide enough information about the document to enable it to be identified.

In addition to the above requirements, an individual applying to have their personal information amended must have previously accessed the document.  This does not need to have been access under the RTI Act or the now repealed provisions of the Information Privacy Act 2009.  For example, the applicant may have:

  • viewed the document on a computer screen
  • read it but not been given a copy of it
  • seen an extract from it; or
  • had it read to them over the phone.

There is no application fee for an application to amend personal information.

Reviewing a decision

If an application is dissatisfied or "aggrieved" with the decision made regarding amendment to documents they can apply to QFD for an internal review of the decision, or apply to the Information Commissioner for an external review of the decision.

To apply for an internal review of a decision the applicant must apply in writing within 20 business days of receiving the decision.

The internal review application will then be referred to a delegated internal review officer for decision.
